  Despite good intentions and relationships, conflicts or misunderstandings arise.  When a client of our firm brings an issue to us, we listen, review the documents provided and formulate a plan to deal with the situation.  Initially, we try to open a line of communication with the adversary to determine whether matters can be resolved without the need for litigation.  Often a misunderstanding can be resolved without resorting to litigation, however, conflicts that cannot be resolved with this approach are prepared for litigation.  During litigation, we aggressively pursue the claims or defenses of our clients, and encourage input from our clients to ensure that the litigation remains focused on their goals.

   Every litigant in New York has a right to appeal a determination with which he disagrees.  The appeals process is a way for litigants to ensure that the existing law was properly applied to their particular situation.  John K. Moss, P.C. is fully familiar with the appeals process.  During lower Court litigation, we ensure that the record of proceedings is clear.  At the appellate level, we pursue all legally sound arguments to pursue and protect our clients' interests

Moss, P.C. has been engaged by numerous small business entities and individuals seeking to establish their businesses.  Our firm counsels on the best entity form for a particular enterprise and undertakes the steps necessary to establish the proper entity for our clients.  Thereafter, documents associated with the internal governance of the entity are prepared which reflect our clients' concept of how their business is to be run.  Drafting services are also provided to prepare "form" type agreements, such as order forms, service retainers, and commission contracts  or more specific agreements, such as leases, construction contracts and proposals or bids for public contracts, as necessary.

  In the event that a conflict arises which must be litigated, John K. Moss, P.C. protects and pursues its clients' interests in a focused cost effective manner aimed at resolving the conflict so that the client may get back to business.  

   We offer to our small business clients an opportunity to participate in a monthly retainer arrangement which affords them up to one hour of monthly legal counseling and a reduction of the firm's standard fees on document negotiation and preparation, further legal consultation and litigation.

Moss, P.C. has developed skills focused on representing municipal clients.  Familiar with federal Community Block Grant Funding  and other planning and economic devices, we have served as counsel to a number of municipal clients in urban renewal planning, "downtown development", affordable housing, grants, and litigation.  We have also assisted in revising relevant municipal codes  and establishing proper procedures for the conduct of activities and programs.

  As hard as it is to think about, a proper estate plan will ensure that your wishes concerning the distribution of your assets on death will be met.  More importantly, if you have minor children, a proper estate plan will ensure that the guardian which YOU choose will be given custody of your children to raise in the manner which will best reflect your values.

Moss, P.C.  approaches small estate planning with documents aimed at addressing the typical needs of individuals and families.  These documents include a Last Will and Testament, a Power of Attorney and a Health Care Proxy.  When it appears that an estate would require a more "specialized" plan, John K. Moss, P.C. can refer its clients to attorneys concentrating their practice in that area.

  We strongly urge that your estate plan be reviewed at least every five years and more frequently when a life changing event (having a child, losing a spouse, winning the lottery, etc.) occurs.
